The Supreme Court has, in a judgment today February 11, 2016 upheld the election of Darius Ishaku as the duly elected governor of Taraba State, which was in affirmation with an earlier decision of the Court of Appeal.
The apex court in today's judgement ended the much litigation on who should be the governor of Taraba State.
It could be recalled that on December 31, a five-member panel of the Appeal Court in Abuja had nullified an earlier ruling of the Taraba State Election Tribunal on November 7, which declared the current Minister of Women Affairs, Mrs. Alhassan winner of the April 11 election of the state. Following the Appeal Court ruling, Mrs. Al-Hassan had therefore, approached the Apex court to set aside the Court of Appeal Abuja's ruling that upheld the election of Ishaku.
Justice Bodeh-Rhode Vivore, who lead judgement of a seven-member panel said:
“I am firmly of the view that there is no merit in this appeal. It is hereby refused, the judgement of the court of Appeal is affirmed and the return of the first respondent as the governor of Taraba is affirmed.”
Going further, the apex court stressed that the issue of nomination of a candidate by a political party “is clearly a pre-election matter and sacrosanct to the political party, which no tribunal has the jurisdiction to entertain”. The court therefore states that the state election tribunal had no power to nullify the election of Ishaku on the ground that he was not validly nominated by the PDP.
The reason for the judgement will however, be given on February 22, the Supreme Court said.
