The Court of Appeal in Abuja has upheld the election of Governor Darius Dickson Ishaku of the People Democratic Part (PDP) in Taraba State.
The court which sat with a five-member panel led by Justice Abdul
Aboki in the ruling, said that the PDP’s
decision to choose Mr Ishaku as its candidate was accepted by the
Independent National Electoral Commission (INEC) and could not be questioned by a non-member of
the party. Thus stating that his nomination complied with section 85
of the electoral act.
The judges said the constitution clearly states that unless a candidate
has been indicted by a court of law, or is known to have a criminal
record, or has certain degree of health condition, among others, such a
person cannot be determined by a tribunal as not being qualified as a
candidate.
The Court, therefore, upheld Mr. Ishaku’s election, after upholding most of his 3 grounds of appeal against the cross-appeal filed by the candidate of the All Progressive Congress , Aisha Alhassan, who had asked for the cancellation of the election.
